The government of the Russian Federation approved a "roadmap" of transformation of the business climate in the sphere of intellectual property
By order of the Government of the Russian Federation from August 3, 2020 No. 2027-R approved plan of measures (road map) implementation management system changes of the legal regulation of business "Transformation of the business climate," "Intellectual property".
In the Road map included measures aimed at creating new ways of managing rights to the results of intellectual activity (RIA), improving the legal framework for the protection of the holders, the support for technology development.
The mechanism of transformation of the business climate for the implementation of which developed the Plan, accumulates the previously formulated initiatives to remove barriers for business in the commercialization REED and use them as profile of liquid asset.
In particular, it is proposed to allow citizens, including the self-employed to register trademarks. It is planned to form the legal basis for the issuing of electronic patents and applications of 3D models in patent applications. In addition, benefits are provided for income tax in respect of income from royalty payments, expanding the list of areas of scientific research, the opportunity for scientific and educational institutions to use exclusive rights as a contribution in start-up capital start-UPS.
In addition, the document suggests the implementation in the Russian legislation of the norms of international law, in particular: the ratification of the Treaty on trademarks, service marks and appellations of origin of goods the Eurasian economic Union, the Protocol on protection of industrial designs under the Eurasian patent Convention of 9 September 1994
It should be noted separately under the Road map, the activities of the digitization capabilities to manage intellectual property rights, trafficking and protection. We are talking about amendments to the Civil code of the Russian Federation in terms of securing opportunities to dispose of the rights to intellectual property through information systems (including distributed registries) and equating such an order to writing the transaction.
For each of the 24 areas of work prepare bills. Part of normative legal acts to be approved by the end of 2020.
In the course of work to develop a roadmap for the responsible authorities was considered and partially taken into account the proposals of the RSPP's Committee on intellectual property and the creative industries. The Plan includes a series initiated by the Russian Union of Industrialists and entrepreneurs of activities on improvement of normative legal regulation in the sphere of intellectual property.
The document provides updated information on the implementation of the action Plan, therefore there remains the possibility of further dialogue of the RSPP's Committee on intellectual property and the creative industries, expert groups, authorities, entrepreneurs, and industry experts on the issues of system changes in the business environment at all stages of the life cycle of the REED.
