Focuses on the draft Federal law "On amendments to article 7 of the Federal law "On trade unions, their rights and guarantees of their activity"; the draft decree of the government of the Russian Federation "On approval of the coefficient of indexation of payments, benefits and compensation in 2021"; the proposals on amendments to the legislation of the Russian Federation to use in the field of labor relations electronic documents, and others.
In his speech, Alexander Shokhin noted that the issues included in the agenda of RTK most relevant to business is the consideration of the preliminary report on the results of the experiment on the use of electronic documents related to the work.
"It is obvious that the analysis of the results of the experiment should give a complete solution of the problems associated with electronic documents. We understand that its development will require changes not only to the Labour code, but perhaps in a number of other laws, such as the use of digital signatures, archiving," said Alexander Shokhin.
According to Deputy Minister of labor Alex Sklar, in the experiment on the transition to electronic document management in the field of labor relations involved more than 380 employers. At the same time, he added, and 30 of them have switched to an electronic document. In the experiment, in the Ministry of labor received 180 complaints from employees, associated mainly with incorrect work of the information systems. Complaints related to the violation of labor rights in the experiment, the Ministry did not, said Alexey Sklyar.
"In the draft roadmap for the development of e-HR workflow is planned to amend the Labour code until 31 July 2021, and extend the experiment for the same period. To ensure the timely development under the roadmap bills deem it necessary to appeal to the government to finalize and approve the road map and to monitor its implementation. Offer to include such an entry in the draft decision of the RTC," said Alexander Shokhin.
According to him, it is necessary to pay attention to further elaborate the use of electronic signatures, in particular, a simple electronic signature (PEP) on the part of employees. This is to be reflected in the decision of the order, the Ministry of labor to hold a special meeting to discuss the application of electronic signatures with the involvement of other Federal ministries, which are responsible for the decision of this question.
The Chairman of the FNPR Mikhail Shmakov, in turn, said that the results of the experiment on introduction of electronic document management can not be judged by those eight months, during which it was held.
"We understand the desire of the Ministry of labor quickly this all possible, but fast isn't necessarily good. We got absolutely irrelevant numbers, based on which we are now trying to build the entire future policy," said Mikhail Shmakov.
